Outlined below are the terms of use of service(s) offered by TextingConnection.com. TextingConnection.com serves three distinct groups of customers - defined below:

Customers

Customers are people who subscribe to text messages from businesses in order to save money and/or time in the course of doing businesses with a businesses registered to TextingConnection.com. The only charges incurred by this group of users is any charged levied by your cell phone company for text messages.

Businesses

Businesses pay a monthly or annual fee to TextingConnection.com in exchange for the ability to use our website to send text messages to those who have subscribed to receive those messages. Customers may subscribe to additional messages and unsubscribe from businesses at any time.

Affiliates

Affiliates are commission only sales people who sell the services offered by TextingConnection.com. Presently, we offer the service of providing a website a method to send text messages to subscribers.

At present, our sales affiliates earn 33% of the fees collected from their clients as a commission. The commission will be earned for each month the business continues to pay the monthly fee or the annual fee to pay for the entire year.

Common Clauses

Merger and Integration

This Agreement and the exhibits attached hereto contain the entire agreement of the parties with respect to the subject matter of this Agreement, and supersede all prior negotiations, agreements and understandings with respect thereto. This Agreement may only be amended by a written document duly executed by all parties.

Choice of Law

This agreement shall be interpreted under the laws of the State of Tennessee. Any litigation under this agreement shall be resolved in the trial courts of Hamblen county, State of Tennessee.

Statute of Limitations

The parties agree that any action in relation to an alleged breach of this Agreement shall be commenced within one year of the date of the breach, without regard to the date the breach is discovered. Any action not brought within that one year time period shall be barred, without regard to any other limitations period set forth by law or statute.

Non-Waiver

The failure by one party to require performance of any provision shall not affect that party's right to require performance at any time thereafter, nor shall a waiver of any breach or default of this Contract constitute a waiver of any subsequent breach or default or a waiver of the provision itself.

Severability

If any provision of this Contract is held unenforceable, then such provision will be modified to reflect the parties' intention. All remaining provisions of this Contract shall remain in full force and effect.

Privacy Policy

Your contact information is kept private. We do not sell, rent, or share you information with anyone. The businesses to which you subscribe do not have access to your contact information. Businesses are told how many text messages have been sent, but no details of who received the messages. A customer may opt to not provide their street address, but city, state and zip codes are required to help us match you to businesses in your area. Businesses are required to provide street address along with city, state and zip to allow customers to find the business. Sales affiliates are not required to register with their street address and social security number, but by the time TextingConnection.com is ready to pay an affiliate, we will need additional information for reporting to the IRS.

We use third-party advertising companies to serve ads when you visit our website. These companies may use information (not including your name, address, email address, or telephone number) about your visits to this and other websites in order to provide advertisements about goods and services of interest to you.
